Motion to dismiss filed in sexual abuse case

Martha and Michael Pitts, both of Martin, were arrested in March 2009 and charged with multiple counts of criminal and sexual abuse. Yesterday, Commonwealth's Attorney Brent Turner filed a motion to dismiss those indictments in Floyd County Circuit Court.

The Pitts had each been indicted with two counts of first-degree rape of a victim under 12 years of age, two counts of first-degree sodomy, two counts of incest with a victim under 12, two counts of first-degree sexual abuse and two counts of first-degree criminal abuse of a child 12 or under.

In the motion, Turner stated that after the indictments were presented, the primary victim and lead witness disclosed that he had “initiated significant sexual contact with three other children,” including the other alleged victim in the case. No charges were filed, and the victim was transferred to an out-of-state treatment facility.
