Martin seeks $60K in fees from Floyd County

The city of Martin filed a lawsuit last week against the Floyd County Fiscal Court for allegedly failing to pay nearly $60,000 in fees.

According to filings in Floyd Circuit Court, on March 18, Martin entered into an agreement with the county to provide disposal of wastewater produced from the county’s landfill located at Garth Hollow at a rate of $38 per 1,000 gallons of wastewater/leachate processed. Court documents state that the county has "failed and refused to make payment as required."

The City of Martin’s suit states that they terminated the service effective May 15, though the county continued to use the service "for sometime thereafter." Martin is asking for the remainder of the outstanding balance of $57,089.55, with late charges of 5 percent per month on all unpaid balances.

Additionally, the suit asks for 12 percent interest annually on any judgement until it is paid in full.
